General provisions, definitions

1.1 These are the visitor terms and conditions of Museumpark Orientalis, hereinafter referred to as MPO.

1.2 Hereinafter, 'the museum complex' is understood to mean the entirety of spaces (built and unbuilt) that fall under the legal and/or management authority of the Heilig Landstichting, including but not limited to the museum grounds, exhibition halls, and meeting rooms, restaurants, storage, terrace, and other outdoor space(s).

1.3 Hereinafter, 'visitor' is understood to mean anyone who, in any manner whatsoever, directly or indirectly, and whether or not in a school or group context or otherwise pursuant to an agreement concluded with the MPO, enters the museum complex during regular opening hours with the purpose of visiting the museum in general, entering its grounds, visiting an exhibition, or attending an activity.

1.4 These visitor terms and conditions form part of every agreement between the MPO and a visitor. The visitor terms and conditions apply to anyone entering the museum complex, even if that person has not directly or indirectly entered into an agreement with the MPO.

Ticket sales, offers and prices

2.1 All quotations, announcements, or other information provided by the MPO are without obligation. The visitor is obliged at all times to show the admission ticket to the museum complex to an MPO employee upon request.

2.2 The visitor is not entitled to a refund of the admission price or any other compensation in the event of loss or theft thereof, or if the visitor fails to use it or does not use it in a timely manner after purchase, or if the validity of the admission ticket has expired. Furthermore, an admission ticket, once obtained, cannot be exchanged. The MPO will refund the admission price paid by the visitor only if the visitor is required to leave the museum complex prematurely due to a calamity and this therefore constitutes force majeure.

2.3 The MPO may deny the visitor access to the museum complex if it appears that the admission ticket or voucher was not obtained from the MPO or an entity authorized by the MPO to do so, is forged, or was obtained unlawfully in any other way.

Stay in the museum complex

3.1 The visitor's stay in the museum complex is entirely at the visitor's own expense and risk. During their stay in the museum complex, the visitor must adhere to the house rules of the MPO and behave respectfully towards both the staff and other visitors of the museum, as well as treat the museum collection with respect. The visitor is also obliged to follow directions and instructions from the MPO at all times, such as those from museum attendants and security personnel. If, in the opinion of the MPO, the visitor acts in any way contrary to the house rules, standards of decency, or directions or instructions from the museum staff, the visitor may be denied further access to the museum complex without the visitor having any right to reimbursement of the cost of the admission ticket or of any kind whatsoever.

3.2 Parents or guardians of minor children must ensure that exhibited objects and exhibition materials are not touched by the children they bring along. Parents or other guardians of minor children are at all times liable for the behavior and actions of the children they bring along. Teachers and other group leaders must ensure that exhibited objects and exhibition materials are not touched by the group members they supervise. Teachers and/or the schools under which they fall and other supervisors are at all times liable for the behavior and actions of the pupils and/or group members they supervise. Parents or other guardians of minor children and/or teachers and other group leaders are responsible for the safety of the minor children and/or group members they bring along.

3.3 Visitors are prohibited from, among other things, in the museum complex:

  1. to offer goods of any kind for sale to third parties;
  2. to intentionally and persistently block the path of other visitors or to persistently obstruct the view of exhibited objects;
  3. to disturb other visitors, for example through the use of mobile phones, (mobile) sound sources or other sources of noise nuisance;
  4. to smoke in the rooms;
  5. to bring along illegal narcotics;
  6. to carry dangerous objects or substances in the opinion of the MPO.

3.4 The MPO may request to inspect the (hand) luggage carried by the visitor.

3.5 Visitors are prohibited from making or having made photo, video, and film recordings using lights, flash equipment, and tripods without prior written permission from the management of the MPO.

3.6 In the event of theft, vandalism, or nuisance caused by the visitor, including but not limited to the conduct referred to in Article 3.3, the MPO will hold the visitor liable for the damage and file a report with the police and judicial authorities. Additionally, the MPO may deny access to the museum complex for a period to be determined by the MPO to any visitor who is established to have intentionally damaged an object or who, in the opinion of the MPO, has behaved in serious violation of standards of decency, house rules, and/or these visitor terms and conditions. The MPO reserves the right to forward the description of a visitor who has damaged an object belonging to the MPO to another museum and/or the police or judicial authorities. By entering the museum complex, the visitor consents to the processing of their personal data for this purpose.

3.7 If the visitor causes damage to an object belonging to the MPO, the MPO reserves the right to recover all restoration and repair costs from the visitor, without prejudice to the MPO's right to full compensation.

3.8 If damage is caused by a minor visitor, or by members of a group of visitors, for whatever reason, then, in addition to the visitors concerned, the parents, guardians, and/or the organization that has booked or is booking a group visit shall be jointly and severally liable to the MPO to compensate the damage caused by the minor visitor(s) and/or the group member(s).

Complaint

4.1 Complaints relating to the visitor agreement must be submitted in writing to the MPO within eight working days following the day on which the visit took place. Complaints submitted after this period will not be processed by the MPO. The MPO will investigate the complaint and, in principle, respond in writing within 30 days of receipt. If the investigation has not been completed within this period, the complainant will be informed of this, as well as the probable date on which it will be completed.

4.2 Complaints cannot be lodged with regard to the following (categories of) circumstances, among others:

  1. complaints relating to the non-visibility of objects from the permanent collection of the MPO.
  2. complaints relating to the partial closure of the museum complex, such as, for example, the partial closure as a result of the
    setting up or dismantling exhibitions and the like;
  3. complaints and circumstances relating to nuisance or inconvenience caused in any way by other visitors, such as, for example
  4. noise nuisance, inappropriate behavior, theft, harassment and the like;
  5. complaints and circumstances relating to nuisance or inconvenience caused by maintenance work, such as renovations or the (re)arrangement of spaces in the museum complex and the like;
  6. complaints and circumstances relating to nuisance or inconvenience caused by the improper functioning of facilities in the museum complex.

Liability of the MPO

5.1 The visitor's stay in the museum complex is at their own risk.

5.2 If, during their visit to the museum complex, a visitor sustains physical injury or worse for any reason whatsoever—for example, due to falling, bumping, or falling into water—and/or damage to or loss of property occurs, the MPO excludes liability for this, unless, having considered the foregoing, liability for the damage in question is attributable to it and if and to the extent that it is insured for this, or should reasonably have been insured. Liability for damage is then limited to the amount that the insurer will pay out in the case in question.

5.3 The MPO's liability for indirect damage, including consequential damage, lost profits or wages, lost savings, etc., is always excluded.

5.4 The liability of the MPO is excluded for, among other things:

– damage resulting from the actions of third parties (visitors);

– damage resulting from one's own fault, such as from failure to comply (in a timely manner) with

instructions from MPO staff.

5.5 The MPO shall never be liable for damage caused to vehicles parked in the MPO parking lot, unless such damage was caused by the museum (or its staff) itself or the MPO or its staff member is at fault.

5.6 If the MPO receives goods or if goods are deposited, stored and/or left behind in any manner whatsoever, anywhere, by anyone, without the MPO demanding any compensation for this, the MPO shall never be liable for damage to or in connection with goods, however caused.

5.7 The exclusion and/or limitation of liability included above shall not apply if the damage is the result of intent or willful recklessness on the part of the MPO or its management and such damage is otherwise also attributable to it.

5.8 The MPO shall never be liable for damage resulting from force majeure on the part of the MPO. Force majeure shall also be understood to mean any circumstance independent of the will of the MPO that temporarily and/or permanently prevents access to the museum complex, exhibitions, and/or performance of the agreement, to the extent not already included therein, riots and civil unrest, intervention by the police and/or fire brigade, strikes, weather conditions, fire, power and other serious disruptions, and/or public transport not functioning for any reason whatsoever.

Lost and found

6.1 Objects found by the visitor in the museum complex can be handed in at the ticket counter.

6.2 In the event that the owner or rightful claimant of the found object comes forward, they have the choice of collecting the goods themselves or having them sent to them COD. In both cases, the owner or rightful claimant must provide proper identification.

Applicability of other terms and conditions

7.1 The applicability of these visitor terms and conditions does not affect the possible applicability of other (contractual) terms and/or regulations of the MPO.

Governing Law and Choice of Forum

8.1 The agreement(s) with the MPO and the visitor terms and conditions are governed by Dutch law.

Other provisions

9.1 The MPO reserves the right to amend these visitor terms and conditions.

9.2 Should it be established that any of the provisions mentioned above is void, such invalidity shall not affect the validity of the remaining provisions mentioned in these visitor terms and conditions.

9.3 These visitor terms and conditions have been established by the management of the MPO.

Provisions in light of Corona

10.1 If, in light of the fight against the coronavirus, the government decides that no or only a limited number of visitors are permitted at MPO, it is possible to cancel the reserved (group) visit free of charge. Any costs already incurred will be settled in consultation.
